When someone dies, their assets need to be distributed as outlined in their Will or in accordance with the rules of intestacy. There are a number of steps involved in this which we can carry out on your behalf.
The Grant of Probate is the document that appoints an executor to deal with the estate. We can send the application to the Probate Registry for you along with the relevant probate fees. If you would like a professional executor to be appointed, that can be arranged using one of our probate solicitors in Fareham.
The assets in the estate need to be identified and valued. This could include investment accounts, shares, property and valuables.
Any Inheritance Tax liability needs to be calculated and paid to HM Revenue & Customs and the Income Tax position assessed.
Assets then need to be collected in, for example by sale of shares and closure of investment accounts, and the money deposited in the executor’s account.
Where the estate includes a property, our conveyancing team can deal with the sale or transfer on your behalf. They understand the importance of dealing with matters quickly to allow the administration to be finalised.
If the will sets up a trust, we can advise you on the implications of this, draw up the necessary documentation and stay involved as needed to advise the trustees and prepare trust accounts.
In the unfortunate event that a disagreement arises over an estate, our expert contentious probate solicitors will be able to offer advice and assistance. We have considerable experience in the area of contested probate, so let us know if you have any concerns and we will be able to help you decide how to proceed.
We are committed to clear and transparent pricing. We understand that having fixed fee probate solicitors is reassuring to our clients and wherever possible we offer that fee structure. For a complete breakdown of likely costs, see our Probate Pricing page.
After the death of a loved one, dealing with paperwork can be upsetting, complicated and frustrating. We aim to take all of the stress away from the process. We will explain the course of action to you and keep you updated while taking on the burden of the difficult and time-consuming administration on your behalf.
Using an experienced local firm is an advantage when dealing with a probate matter. You can attend us in our offices or, if that is not possible, we are happy to visit you at your home. There is no substitute for experience and we believe that the service we offer cannot be beaten.
