Agency and distribution agreements
An agent is one who is retained to act on behalf of a principal and to contract for and on behalf of that principal. In contrast, a distributor contracts for the distributor’s own account. In either instance, a number of considerations must be taken into account to ensure the agreement protects the interests of all parties. In addition, there are a wide range of laws applying to both agency and distribution arrangements.
